Warmington Allotments

The Parish Council has leased land for allotments from Elton Estates along the side of Stamford Lane. A management committee has been formed and an agreement for renting a plot drafted.   1. Access to be from Stamford Lane.
  2. To put and keep the land in good state of cultivation with proper rotation of crops.
  3. Not to keep dogs, pigs, fowl, bees or livestock on the land.
  4. Not to allow accumulation of rubbish or scrap metal on the land.
  5. One communal building for tools etc will be allowed on site. This will be purchased by the Parish Council and remain the property of the Parish Council.
  6. The Parish Council will maintain and repair and fence, hedge or other boundary demarcations for which allotment holders will have to allow access.
  7. Allotment holders will be required to required to respect the privacy of surrounding neighbours. Particular care is to be taken with bonfires. Allotments holders are recommended to follow the codes of practice for bonfires, specifically those issues East Northamptonshire Council.
  8. There will be no parking on the land or access for vehicles.
  9. Water rates will be paid by the Parish Council subject to the allotment holders reasonable use of water.
  10. A member of the Parish Council will be appointed to serve on any committees convened by the allotment holders and to police the land. All members of the Parish Council have the right to visit the land. Allotment holders are encouraged to report any defects or other issues to the Parish Councillor responsible for the allotments or to any Councillor, and the Clerk.
  11. This agreement may be determined by either party by giving 6 months notice in writing expiring on the last day of the month. The annual rent of £50 for a whole plot and £25 for half a plot to be paid annually in advance by 1st May.
  12. Rents will be reviewed by the Parish Council annually in January.
  13. If the rent hereby reserved shall remain unpaid on the 1 of May (whether legally demanded or not) or if the allotment holder shall fail to observe or perform any of the above conditions, it shall be lawful for the agreement to be terminated, but without prejudice to any of the legal rights and remedies of the landlord.
  14. Any clearing of the land to be done by the allotment holder to the standard the land was let. If the land is not cleared after 1 month of termination the Parish Council will clear the land and charge to the allotment holder concerned.
  15. In the event of the death of an allotment holder this agreement may be determined by the landlord giving 2 calendar months notice in writing to expire any time to the personal representative of the allotment holder.
  16. This agreement is not a contract of tenancy for the purpose of the Agricultural Tenancies Act 1995 or any other Statute.
  17. The Parish Council has security of tenure until 2008. From that date the landlord has the right to terminate the lease subject to giving 12 months notice.
